1. Introduction and Agreement to Terms
These Terms of Use constitute a legally binding agreement between the user (hereinafter: "you" or "the user") and the developers of the "WA auto" application (hereinafter: "the Application"). Your use of the Application, including downloading, installing, or accessing it, constitutes full and unconditional agreement to all the terms set forth below. If you do not agree to these terms, you may not use the Application.
2. Description of Service
The Application is a utility tool designed to streamline and assist in the manual process of sending WhatsApp messages to a list of recipients. The Application acts as an interface that prepares the message and recipient each time, but the sending action itself is performed manually and initiated by you from within the WhatsApp application. The Application does not perform automatic sending in the background.
3. License to Use
We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use the Application for your personal or internal business use, subject to the terms of this agreement. This license does not grant you any ownership rights in the Application.
4. Subscription Model and Payments
The free version includes a total of 20 chat openings. Premium allows unlimited openings for a recurring monthly subscription. The price, currency, taxes and any eligible trial are shown by your app store before purchase. Unless canceled through your store account, the subscription renews automatically. You can manage or cancel it in your store subscription settings. Sending is still confirmed manually in WhatsApp.
5. User Responsibility and Proper Conduct
The full and exclusive responsibility for the content of the messages, the legality of the recipient lists, and the consequences arising from the use of the Application rests solely with you. You undertake not to use the Application for illegal purposes, including sending spam, harassment, defamation, or any action that infringes on the privacy or rights of any third party.
6. No Affiliation and Disclaimer Regarding WhatsApp
The Application is a third-party utility and is not affiliated with, endorsed, sponsored, or supported by WhatsApp Inc. or its parent company, Meta. Your use of this Application, which generates repetitive activity, may conflict with WhatsApp's terms of service and be considered suspicious activity by them. You acknowledge and understand that use of this Application is at your sole risk and may lead to restrictions on your WhatsApp account, including temporary or permanent blocking. The developers bear no responsibility for any outcome related to your WhatsApp account.
7. Intellectual Property
All copyrights, trade secrets, patents, and other intellectual property rights in the Application are the exclusive property of the developers. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Application.
8. Limitation of Liability
To the maximum extent permitted by law, the developers shall not be liable for any direct, indirect, special, consequential, or punitive damages (including but not limited to, loss of profits, loss of data, damage to reputation, or blocking of a WhatsApp account) arising from the use or inability to use the Application, even if the developers were aware of the possibility of such damages. The Application is provided "AS IS" and "AS AVAILABLE".
9. Indemnification
You agree to indemnify, defend, and hold harmless the developers from and against any and all claims, liabilities, damages, losses, or expenses (including attorneys' fees) arising from or related to your use of the Application, your violation of these terms, or your violation of any third-party rights.
10. Privacy
Messages and recipient lists are saved locally on your device. Opening a chat transfers the selected number and message to WhatsApp, whose privacy policy applies. Purchases are processed by Apple or Google under their terms. Support emails contain the information you choose to send.
Subscriptions are verified by RevenueCat using store purchase information and a random app identifier. Message content and recipient lists are not sent to RevenueCat.
If you enable optional diagnostics, Google Firebase receives usage events, technical crash reports and an app installation identifier. You can disable collection at any time in Settings. We do not attach messages, phone numbers, names or imported files to these reports.
Optional diagnostics also include device and operating system details. Google Analytics derives an approximate region from the network address.
Use Settings to clear saved messages, recipients, lists, templates and campaign history. Your subscription and free-opening count are kept. Device backups are controlled by your operating system.
Purchase records are retained as needed to verify subscriptions and meet legal obligations. Optional diagnostics follow Firebase's retention rules. For a privacy or deletion request, contact afek10@gmail.com; for purchase records, include only your store order ID. Do not send messages, recipient lists or CSV files. Deleting data does not cancel a store subscription.
11. Termination of Service
We reserve the right to terminate or suspend the provision of services or your access to the Application, temporarily or permanently, for any reason, without prior notice and at our sole discretion.
12. Miscellaneous
These terms constitute the entire agreement between you and the developers. These terms shall be governed by the laws of the State of Israel, and the exclusive jurisdiction for any dispute shall be vested in the competent courts in the Tel Aviv-Jaffa district.
